Halle Berry Instagram post sparks dispute in custody hearing with Martinez

A quote about fathers and disrespectful kids appeared on Berry's account amid her custody trial, then vanished — the post's timing drew courtroom attention.

How does this story make you feel?

A pointed Instagram Story quote materialized on Halle Berry's account on the day before closing arguments in her custody trial and vanished almost as quickly as it appeared. The message read: If kids disrespect their moms, the root cause often traces back to the relationship with the father.

The post's timing — appearing immediately after evidence closed in her Los Angeles Superior Court hearing against ex-husband Olivier Martinez — made it impossible to ignore inside the courtroom.

Martinez's attorney, Patrick Baghdaserians, asked Judge Shelley Kaufman to reopen evidence so Berry could be questioned about the post, arguing it violated a temporary restraining order already in place against her.

This sort of conduct is the reason we are here today.— Patrick Baghdaserians, attorney for Olivier Martinez

Baghdaserians told the court the post was 'disturbing my client's peace, disturbing my client's calm,' according to Page Six. He also pushed back on any suggestion that the media presence in the courtroom influenced his decision to raise the issue publicly, saying he did not care about reporters being present.

Berry's attorney, Marina Beck, was unsparing in her response.

They just intended to re-open evidence and continue their false narrative.— Marina Beck, attorney for Halle Berry

Beck also suggested the motion was deliberately made in open court in front of reporters, according to Page Six. Judge Kaufman denied the motion, and the courtroom was cleared for closing arguments. A decision is expected Thursday.

The hearing is the culmination of a legal dispute that escalated sharply in early October. Martinez, 60, sought sole custody of the couple's 13-year-old son Maceo and a domestic violence restraining order, alleging Berry physically abused the boy during a Sept. 26 incident at her home — specifically that she put her hands around his neck and choked him during an argument over a video game. Berry has vehemently denied the allegations. Her attorney previously called Martinez's filing 'entirely meritless and deliberately misleading,' according to Page Six.

A judge granted Martinez a temporary restraining order on Oct. 1, along with temporary primary physical custody of Maceo and restrictions on Berry's parenting time. That order has since been extended while the court considers the allegations.

Berry has countered that Martinez interfered with Maceo's education and therapeutic care and drew their son into the legal dispute, according to Page Six. She is asking the court to dismiss the restraining-order request, restore their previous 50-50 physical custody arrangement, and grant her sole legal authority over decisions involving Maceo's education and medical care.

Berry and Martinez married in 2013, the same year Maceo was born, separated in 2015, and finalized their divorce in 2023 with a 50-50 custody agreement. The nearly two-week hearing now heads toward a ruling that will determine whether that arrangement — and the restraining order — holds.

Why it matters — A judge's ruling expected Thursday will determine whether Berry regains equal custody of her son or remains under a restraining order — and the Instagram episode shows how every move, on or off social media, is now being scrutinized as evidence.
